There are still many valid reasons to file for legal separation. However, you do not need to be
legally separated to obtain a divorce. This is a common misconception. Although New York
recently became a no-fault state a legal separation agreement may still be used as grounds for
divorce. The agreement should be prepared carefully as it is a legal document and many

filed with the County Clerk and followed by the parties.
