Temporary Maintenance
Temporary maintenance (or spousal support) is money paid from one spouse to another during
the pendency of an action. Durational maintenance is paid once the case is finalized and the
divorce is granted. The amount of payments is based upon a formula which was recently enacted
to provide greater consistency. The formula considers the parties respective earnings and the
length of the marriage. The parties can agree to deviate from the amount determined by the
formula on consent.
